Kamp, normal hukuksal d\u00fczenin d\u0131\u015f\u0131na yerle\u015ftirilen bir toprak par\u00e7as\u0131d\u0131r; fakat \u00f6yle d\u0131\u015far\u0131da bir yer de de\u011fildir.\u00a0<em>D\u0131\u015far\u0131da tutulan<\/em> anlam\u0131na gelen &#8220;istisna&#8221; (<em>ex-capere<\/em>) teriminin etimolojik anlam\u0131 do\u011frultusunda d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcm\u00fczde, kampa al\u0131narak d\u0131\u015far\u0131da tutulan \u015fey tam da d\u0131\u015flanmak suretiyle i\u00e7leniyor. Ancak burada \u00f6ncelikle hukuksal d\u00fczenin i\u00e7ine \u00e7ekilen \u015fey, tam da istisna durumunun kendisidir. \u0130stisnai durum, &#8220;iradi&#8221; oldu\u011fu s\u00fcrece, kural ile istisnan\u0131n birbirinden ayr\u0131lamaz hale geldi\u011fi yeni bir hukuksal-siyasal paradigma kurmu\u015f oluyor. Dolay\u0131s\u0131yla kamp, istisnai durumun -ki egemen iktidar\u0131n temeli bu durumun belirlenmesidir-\u00a0<em>kural olarak<\/em> ger\u00e7ekle\u015ftirildi\u011fi\/y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fc yerdir. Burada art\u0131k egemen kendisini, Weimar Almanyas\u0131&#8217;n\u0131n ruhunda oldu\u011fu gibi verili bir ger\u00e7ek durumun (kamusal g\u00fcvenli\u011fe y\u00f6nelmi\u015f tehlike) saptanmas\u0131 ba\u011flam\u0131ndaki bir istisna karar\u0131yla s\u0131n\u0131rlam\u0131yor: Burada art\u0131k egemen, kendi iktidar\u0131n\u0131 tan\u0131mlayan yasaklaman\u0131n i\u00e7sel yap\u0131s\u0131n\u0131 d\u0131\u015far\u0131 vurmak suretiyle, istisna \u00fczerindeki h\u00fck\u00fcmranl\u0131\u011f\u0131n\u0131n sonucu olarak bu durumu bizzat kendisi yarat\u0131yor. \u0130\u015fte bundan dolay\u0131, dikkatle bakacak olursak, kampta\u00a0<em>quaestio iuris<\/em> [hukuksal sorun] ile\u00a0<em>quaestio facti\u00a0<\/em>[olgusal sorun] tamamen birbirinden ayr\u0131lmaz hale geliyor. Dolay\u0131s\u0131yla da, kampta olup bitenlerin yasal olup olmad\u0131\u011f\u0131 yolundaki b\u00fct\u00fcn sorular anlams\u0131zd\u0131r.\u00a0<em>Kamp, bu iki terimin birbirinden ayr\u0131lmaz hale geldi\u011fi hukuk-ger\u00e7ek melezi bir yerdir<\/em>.<\/p>\n<p>Hannah Arendt bir yerde \u015fu g\u00f6zlemi yap\u0131yordu: Totaliter y\u00f6netimi destekleyen ve sa\u011fduyunun kabul etmeyi \u0131srarla reddetti\u011fi ilke kamp alanlar\u0131nda tamamen ortaya \u00e7\u0131k\u0131yor; bu ilke &#8220;her \u015fey m\u00fcmk\u00fcn&#8221; ilkesidir. Kamplarda ger\u00e7ekten de her \u015feyin m\u00fcmk\u00fcn olmas\u0131n\u0131n tek nedeni, kamplar\u0131n bizim kastetti\u011fimiz anlam\u0131yla -sadece hukukun tamamen ask\u0131ya al\u0131nd\u0131\u011f\u0131 bir yer de\u011fil; ayn\u0131 zamanda da ger\u00e7ek ile hukukun tamamen i\u00e7 i\u00e7e ge\u00e7ti\u011fi- bir istisna mek\u00e2n\u0131 olmas\u0131d\u0131r. E\u011fer kamplar\u0131n -ki kamplar\u0131n g\u00f6revi tam da daimi bir istisna yaratmakt\u0131r- bu kendilerine \u00f6zel hukuksal-siyasal yap\u0131lar\u0131 anla\u015f\u0131lmazsa, bu durumda oralarda cereyan etmi\u015f olan inan\u0131lmaz \u015feyler tamamen anla\u015f\u0131lmaz \u015feyler olarak kalacakt\u0131r. Kampa giren herkes, d\u0131\u015far\u0131 ile i\u00e7eri, istisna ile kural, yasal ile yasal-olmayan aras\u0131ndaki bir belirsizlik m\u0131nt\u0131kas\u0131na girmi\u015f oluyordu; burada \u00f6znel hak ve hukuksal koru[n]ma kavramlar\u0131 b\u00fct\u00fcn anlamlar\u0131n\u0131 yitiriyordu. Bundan ba\u015fka, e\u011fer kampa giren insan bir Yahudiyse, bu insan Nuremberg yasalar\u0131yla b\u00fct\u00fcn vatanda\u015fl\u0131k haklar\u0131n\u0131 zaten yitirmi\u015f birisiydi; bu insan\u0131n kampa girmesi, Nihai \u00c7\u00f6z\u00fcm ba\u011flam\u0131nda tamamen ulusun d\u0131\u015f\u0131na at\u0131lmas\u0131 anlam\u0131 ta\u015f\u0131yordu. \u00d6te yandan kamp, tarihte tesis edilmi\u015f en mutlak biyosiyasal mek\u00e2nd\u0131. \u00c7\u00fcnk\u00fc kamptaki her t\u00fcrl\u00fc siyasal stat\u00fclerinden s\u0131yr\u0131l\u0131yor ve tamamen \u00e7\u0131plak hayata indirgeniyorlard\u0131; burada iktidar\u0131n kar\u015f\u0131s\u0131nda sadece saf hayat vard\u0131 ve bu ikisinin aras\u0131nda hi\u00e7bir arac\u0131 yoktu. Bundan dolay\u0131 kamp, siyasetin biyosiyaset oldu\u011fu ve\u00a0<em>homo sacer<\/em>&#8216;in de vatanda\u015f rol\u00fcn\u00fc oynad\u0131\u011f\u0131 siyaset sahnesinin e\u015fsiz paradigmas\u0131d\u0131r.
